The following terms & conditions define the rights and obligations of the Company Mo’s creations (hereafter the Company), represented by the Lystale brand and by Morgane M. Marsan and of any person who’s buying (hereafter the Customer) as part of the sale of jewelry and accessories on Lystale.com (hereafter the Site)

The Products sold by the Company on the Site are handmade at the order by Morgane M. Marsan. No stock is made, products are make-to-order. The goods being artisanal, it implies that the pictures presented on the Site are not contractual. Slight differences can occur between the pictures and the final product due to the supplies used during the fabrication (stones, wires, …), the fabrication process itself and the pictures quality in general.

The prices of the products sold are the prices in effect at the time of the order. They are expressed in euros, all taxes included except for the delivery charges detailed in the shipping section and added upon checkout. Consequently, the prices will be increased during the checkout process by the delivery charges applicable on the day of the order.
The prices of the products available on the Site are set freely by the Company and take into account the prices of metals and raw materials. The company grants itself the right to modify the sales prices at any time. However, the Company commits that the prices charged be those displayed when ordering.

Coupons issued by the Company are for personal use only, and are time limited. A limit of one (1) coupon can be applied per order, and a coupon can be used only one (1) time by the Customer. The Company grants itself the right to accept, modify or refuse the privileges granted to the Customer via coupons. Expired coupons will not be accepted.

The Customer agrees to respect the terms of payment, ie the full payment at the time of the order.
Payment is made via the secure platform Stripe, where means of payment accepted are : credit card.

No discount will be granted in case of advance payment
Any order paid partially or for which the payment was refused may be cancelled by the Company after it has notified the Customer by all means necessary and available.

Delivery will be made Colissimo, a service provided by the French post, to the address provided by the Client when ordering. Delivery times at the end of the order are given as an indication and can not involve compensation, or cancellation of the order, if they are not honoured by the Company.
When receiving the order, the Customer must ensure that the package is in good condition. It is the responsibility of the Customer to refuse the package if it is damaged. He must also warn the Company so that it can take the necessary measures.

Worldwide : € 15,80

For orders exceeding € 150,00 : Free shipment is applied. 

Additional taxes and/or customs fees can be applied on the shipment and to be paid entirely by the Customer. The Company cannot be held responsable for any taxes/customs fees applied on the order shipment.

The shipment will be assured via Colissimo, you will receive a tracking number to follow it. In some countries the tracking can stop at the French border, don’t feel alarmed! If you ever feel the need to, don’t hesitate to contact me. 

The Customer has a right of withdrawal of 14 days upon the order date. If you decide to use it, you must contact the company which will take the necessary measures to make the full refund. After this time, no refund will be granted. 

The Company is committed to providing after-sales service to its Customers. Under these conditions, the Company will repair or exchange a product, deteriorated under normal conditions of use, or if it has a fabrication defect. No refund will be issued.

Damage incurred during transportation is not the responsibility of the Company, however, the goods can be returned and exchanged, as part of this warranty.

This warranty is valid for two (2) years after the order date.

To make use of this commercial warranty, the Customer must contact the Company by email before any return, must provide a description of the damage with pictures, for records. The Company will provide you a return number and indicate you the procedure to follow.
The Company will cover the return shipping costs if the Customer has contacted the Company prior to the return. If not, the return shipping cost will be at the charge of the customer. If the item is not returned in its original condition, the customer is responsible for any loss in value.

The responsibility of the Company can not be implemented if the non-execution or the delay in the execution of one of its obligations described in these terms & conditions arises from a case of absolute necessity. As such, force majeure means any external event, unforeseeable and irresistible within the meaning of Article 1148 of the French Civil Code.

Any services provide by the Company implies a total agreement and without reserve these Terms & Conditions by the Customer. You are expected to check this page any time you place a new order on the site so you are aware of any changes, as they are binding on you.
Any modifications of these terms & conditions will be noticed on this page. The Company reserves the rights to change these terms at any time.

Any dispute relating to the interpretation and execution of these Terms & Conditions is subject to French law.
In the absence of amicable resolution, the dispute will be brought before the Commercial Court of Bobigny – France.
